This Rental Agreement, User Agreement ("Agreement") is made and entered into by and between ELO House (referred to as "Company") and the customer (referred to as "Guest", "customer", "Tenant") who books and reserves a property through ELO House's website or platform.
1. Property Types:
- ELO House offers two types of properties: those that are self-operated by ELO House and those run by partner property owners who have partnered with ELO House for bookings and reservations.
- Properties include both residential and commercial options.
2. Booking Policy:
- Customers are required to pay 30% of the total rent as a reservation confirmation.
- The remaining balance is to be paid upon check-in.
3. Security Deposit:
- ELO House collects a security deposit that varies based on the property. This deposit is designed to ensure the prevention of any damage to the property or its appliances.
- For specific details regarding the security deposit amount, guests are advised to consult with the reservation manager during the booking process.
4. Property Verification:
- ELO House recommends guests to verify the property before making a booking.
- Verification can be done in person, through photos, or via video streaming.
- Booking a property without sufficient knowledge or verification of its details is not advised.
5. Cancellation and Refund Policy - Daily Bookings:
- If a customer does not show up for a daily booking, the reservation advance collected will not be refunded.
- If a guest checks in but decides to check out due to dissatisfaction or service defects, the refund will be subject to negotiations between the property, ELO House, and the customer.
6. Cancellation and Refund Policy - Mid Stay Cancellation - Daily Bookings:
- In the event of a mid-stay cancellation for daily bookings, only the last two days (T-2) will be refunded.
- T-2 refers to the date of check-out, and the amount for the last two days will be refunded, while the remaining balance will not be refunded.
- However, this policy may vary from property to property. Guests are advised to check with the reservation manager if this policy applies.
7. Cancellation and Refund Policy - Monthly Bookings:
- For monthly bookings, no refunds will be provided in the case of a no-show.
- In the event of immediate check-out after check-in due to dissatisfaction or service defects, refunds will be subject to negotiation between the property, ELO House, and the guest.
- Mid-stay cancellations for monthly rentals are not refundable as the booking is for a monthly period.
8. Refund of Security Deposit:
- The security deposit collected from the Guest will be refunded within a reasonable timeframe after the check-out date.
- The refund process may take up to 7 days to allow the property owner to thoroughly inspect the property for damages, missing items, or excessive cleaning requirements.
- If any deductions are necessary, ELO House will provide an itemized statement outlining the deductions made from the security deposit.
- The remaining balance, after deductions (if any), will be refunded to the Guest's designated payment method.

9. Indemnity:
- The Guest agrees to indemnify and hold ELO House harmless from any damages, liabilities, claims, or expenses arising from the Guest's use of the property.
- This includes but is not limited to damages to the property, injury to individuals, or violation of any laws or regulations during the Guest's stay.
10. Occupancy:
- The property is to be occupied only by the Guests listed in the reservation.
- Subletting or sharing the property with individuals not listed in the reservation is strictly prohibited without prior consent from ELO House and the property owner.
11. Property Usage:
- The property is to be used solely for residential or commercial purposes, as specified in the reservation.
- Any other use, including but not limited to parties, events, or illegal activities, is strictly prohibited without explicit permission from ELO House and the property owner.
12. Property Care and Damages:
- The Guest agrees to treat the property with care and respect and to leave it in the same condition as upon arrival.
- Any damages caused to the property, its furnishings, or appliances will be the financial responsibility of the Guest.
- ELO House reserves the right to charge the Guest's credit card or deduct from the security deposit to cover any damages or necessary repairs.
13. Guest Responsibilities:
- Guests are responsible for their personal belongings during their stay.
- ELO House and the property owner are not liable for any loss, theft, or damage to personal belongings.
14. Liability Waiver:
- Guests understand and acknowledge that ELO House and the property owner are not responsible for any accidents, injuries, or illnesses that occur during their stay.
- Guests are advised to obtain their own travel insurance to cover any unforeseen circumstances.
15. Modifications or Cancellations:
- Any modifications or cancellations to the reservation must be made in accordance with the cancellation policy stated during the booking process.
- Additional charges may apply for modifications or cancellations made outside the specified timeframe.
16. Customer Profile:
- ELO House platforms and properties are intended for use by individuals who are 18 years of age or older to make reservations.
- Guests who are below 18 years of age can stay in the property but must be accompanied by an adult who is 18 years or older.
- The person making the reservation and checking-in must be 18 years of age or older.
- It is the responsibility of the Guest to ensure that any accompanying individuals under 18 years of age are supervised and adhere to all property rules and regulations.
17. Local ID and Address Verification:
- ELO House welcomes guests with local identification documents to make reservations with us, provided that the reason for booking is valid and in compliance with local regulations.
- Foreign nationals who wish to book with us are required to provide the address of a person residing in the same city who can be contacted for verification purposes.
- The provided local ID or address may be subject to verification by ELO House to ensure compliance with local laws and regulations.
- ELO House reserves the right to request additional identification or documentation for verification purposes, and may refuse reservation or check-in if the provided information is not valid or cannot be verified.

18. Variable Costs:
- In certain ELO House properties, there may be additional variable costs that are not included in the rent. These costs may include electricity usage, gas cylinder refills, drinking water, laundry services, and food and catering expenses.
- Guests are advised to check with the reservation manager for specific details regarding the variable costs applicable to the property they are interested in.
- The variable costs mentioned above are separate from the rental amount and will be payable by the guest directly to the designated service providers or as specified by ELO House.
- It is important for guests to clarify and understand the variable costs associated with the property before making a reservation to ensure a clear understanding of the overall expenses involved.

19. Governing Law and Jurisdiction:
- The rental agreement is governed by the laws of the jurisdiction where the property is located.
- Any disputes arising from the rental agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
20. Term:
- The term refers to the booking tenure or duration of the guest's stay in the ELO House property.
- Once the guest checks out, the term is automatically terminated, and the guest will need to make a new booking to use the property again.
- The term is determined by the specific booking dates selected by the guest during the reservation process.
- Guests are advised to carefully review the booking details, including the term, before confirming their reservation.
- Any extension of the term or changes to the booking dates must be discussed and approved by ELO House and are subject to availability.

By making a reservation and accepting these terms and conditions, the Guest acknowledges that they have read, understood, and agreed to be bound by the terms of this Agreement.
